Jeudi 06 février 2014 : CE extra ordinaire

Hier s’est tenu un CE extra ordinaire pour Avon France. La direction a déposé la semaine du 13 janvier une déclaration de cessation des paiements auprès du Tribunal de Commerce de Bobigny.

Suite à cela, la direction et les représentants du personnel ont été entendus lors d’audience tenue le 28 janvier dernier devant le Tribunal, qui a ouvert une procédure de redressement judiciaire par jugement du 30 janvier.

Le Tribunal a fixé une période d’observation de 6 mois et a convoqué la société à une prochaine audience intermédiaire qui se tiendra le 18 mars.

Pendant cette période, l’activité se poursuivra avec l’assistance d’un administrateur, permettant d’évaluer dans un premier temps un plan de redressement avec l’étalement des dettes sur 10 ans (l’Administrateur va demander au groupe s’il serait d’accord avec cette approche). Sinon un plan de cession avec l’établissement d’un calendrier.

A noter aussi que la CE a demandé une nouvelle fois que la direction et le groupe communiquent officiellement sur la situation d’Avon France.

An extra ordinary meeting took place yesterday for Avon France. The top management declare the suspension of payments to the Commercial Court of Bobigny during the week of the 13th of January. Following this, the Top management and the representatives of the employees had a hearing at the Commercial Court on the 28th of January, which led to a receivership decided by the judge on the 30th of January.

The Commercial Court decided on a period of 6 months of observation and all will be heard again on the 18th of March.

In the meantime, the activity will go on with the assistance of a receiver who first will evaluate a receivership plan, spreading the debts of Avon France over 10 years ( the receiver will ask the shareholders if they agree). Otherwise, he will work on an agenda of a transfer plan.
To be noted, the Works Council asked again to the Top Management and the company to communicate officially on Avon France situation.
